Saugus Zoning Board Approves Four Petitions, Continues 40B Case

Saugus Zoning Board of Appeals clears four residential petitions, including a disputed Bayview Road rebuild. The board voted unanimously at its May 28 meeting to approve special permits and variances for projects at 23 Bayview Road, 9 Kent Street, 5 Dream Street, and 77 Elm Street. The Bayview Road case drew the most scrutiny: abutter Jeff Wassner of 9 Bayview Road argued the near-total reconstruction of a 1.5-story cottage into a 2.5-story structure forfeited pre-existing non-conforming protections under the 1996 Appeals Court decision in Code v.

ZBA of Auburn, and raised a privacy concern about sightlines to his swimming pool. The board disagreed, with member Chris Riley stating the project was "not substantially more detrimental" to the neighborhood. Owner Julio Tejada, whose property at 23 Bayview Road sat vacant for approximately 25 years, was cleared to resume construction.

A rolling continuance was also granted in the long-pending 40B application by 20 Bedded LLC for 300 rental apartments, 75 of them affordable, at 20 Rear Bedded Highway, a case now awaiting a court date expected no earlier than December.
