Groveland Commission Approves Water Plant Permit, Defers Generator Pad Dispute

Groveland Conservation Commission approved a contested water treatment plant permit on a 3-1 vote, deferring a bylaw dispute over a generator pad. The commission approved the Notice of Intent for the Town of Groveland's proposed PFAS treatment facility at 183R Main Street, represented by Alston Potts of Apex Companies, but carved out a proposed generator pad at Well 1 after commissioners split over whether the town's wetlands bylaw — which restricts commercial and industrial uses within the 100-foot buffer but has no public utility category or waiver mechanism — applies to critical water infrastructure. Potts told commissioners the project's finished floor elevation of 25 feet is 6.3 feet above the FEMA 100-year flood elevation of 18.7 feet, more than double the Federal Flood Risk Management Standard's three-foot critical-facility minimum.

Resident Francis J. Osborne, 3 Pleasant Street, urged denial, arguing the site sits within approximately 20 feet of the floodplain boundary and that the project was designed before the commission was consulted. The approval preserves access to approximately $15 million in State Revolving Fund financing with an October 2 paperwork deadline; the commission also announced plans to seek town counsel's opinion on adding a public utility category to the local bylaw, a change that would require a Town Meeting vote.
